The Fillmore Chamber of Commerce will host a forum for city council candidates October 7 at 6:30 p.m. at Fillmore City Hall

The forum will be broadcast live over the City’s cable channel, Channel 10.
All eight candidates for city council have been invited to participate in the forum, according to Chamber President Mike McMahan. The event will follow a format similar to forums hosted in the past by the Chamber, including an opportunity for members of the audience to submit potential questions to the candidates. Other questions will be developed for the candidates by the Chamber.
The election on November 4 will determine who will fill three seats on the city council.

Senate Bill 1168 will give peace of mind to parents, students

SACRAMENTO – Earlier this week, Governor Schwarzenegger signed legislation authored by Sen. George Runner (R-Antelope Valley) that allows dependent college students to continue receiving health insurance for up to one year upon taking an academic leave of absence due to serious illness or injury.

“This bill will prevent an unfair situation regarding insurance coverage from occurring,” Runner said. “Students should continue receiving insurance they or their families have paid for if they leave school for legitimate medical reasons.”

Michelle’s Law, or Senate Bill 1168, is named after Michelle Morse, a New Hampshire college student who contracted colon cancer. When advised by doctors to reduce her course load, Morse’s family discovered that she would be required to pay monthly continuation premiums of approximately $550 to keep her policy in effect.

“With this bill, ailing students and their families will be put at ease and allowed to focus on treatment and recovery,” Runner said.

Michelle’s Law goes into affect Jan. 1, 2009.

Governor Arnold Schwarzenegger announced today that he has signed a package of bills to improve patient privacy laws and to address repeated breaches of confidential information that have occurred at health facilities in recent months.

“Medical privacy is a fundamental right and a critical component of quality medical care,” Governor Schwarzenegger said. ”Repeated violations of patient confidentiality are potentially harmful to Californians, which is why financial penalties are needed to ensure employees and facilities do not breach confidential medical information. Californians seeking care at a hospital or health facility should never have to worry that their private medical information will be shared.”

Patients’ legal right to confidential medical services in health facilities is strongly recognized and clearly defined in both state and federal law. However, under current law it is difficult to impose and enforce penalties when breaches occur unless a district attorney or the state Attorney General takes action.

The bills signed by Governor Schwarzenegger give the state tools to assess and enforce fines against health facilities and individuals who inappropriately obtain, use or disclose medical information.

SB 541 by Senator Elaine Alquist (D-Santa Clara) sets health facility fines for privacy breaches and increases the fines for serious medical errors in hospitals. The new law ensures that health care providers face real consequences when they fail to protect patients. For facilities, fines for disclosing private medical information would range from $25,000 to $250,000 per reported event. The California Department of Public Health (CDPH) would assess an administrative penalty of $25,000 per patient whose medical information was breached and a penalty of $17,500 per subsequent breach. If several individuals access the same patient’s file, for example, the penalty would be $25,000 plus $17,500 for each additional person who violated the same file, up to a maximum of $250,000. Californians will benefit from accessible nutritional information at thousands of restaurants

Governor Arnold Schwarzenegger today signed SB 1420 by Senator Alex Padilla (D-Pacoima), which makes California the first state in the nation to have its restaurant chains with 20 or more locations statewide post calorie information on menus and indoor menu boards for consumers.

“This legislation will help Californians make more informed, healthier choices by making calorie information easily accessible at thousands of restaurants throughout our state,” Governor Schwarzenegger said. “By being the first state to provide this information to consumers, California is continuing to lead the nation with programs and policies that promote health and nutrition.”

SB 1420 requires restaurant chains with 20 or more locations to post calorie information on their menus and indoor menu boards by January 1, 2011. And beginning July 1, 2009, brochures containing either calorie content information or other nutritional information, such as grams of saturated fat, grams of carbohydrates and milligrams of sodium, will be at the point of sale and drive-thrus for consumers. The legislation preempts local ordinances in order to create a uniform statewide standard for displaying nutritional information instead of a patchwork of local ordinances, although nothing in the bill would prevent a restaurant from providing additional information if they so choose.

The Governor also signed SB 441 by Tom Torlakson (D-Antioch), which requires each vendor who operates or maintains a vending machine on state property to satisfy the requirement that at least 35 percent of the food and at least one-third of the beverages offered in the vending machines meet accepted nutritional guidelines by January 1, 2011.

The Governor’s leadership has put in place some of the nation’s most innovative and successful strategies to promote health and nutrition. The Governor has:

Established the toughest school nutrition reforms in the nation, taking junk food and sugary sodas off our campuses.
Removed trans fats in school meals and phased out the use of trans fats in all California restaurants beginning in 2010 and from all baked goods by 2011.
Invested millions of dollars in fresh fruits and vegetables in school meals.
Adopted the first-ever physical education standards.
Convened a Summit on Health, Nutrition and Obesity where leaders of public and private sector organizations made significant commitments to change core business practices to help achieve a healthier California.
Reinvigorated the Governor's Council on Physical Fitness and Sports, which focuses on rewarding positive leadership in implementing healthy living in youth.
Proposed a comprehensive health care reform plan that emphasizes prevention and wellness.

According to the California Department of Public Health, Californians have gained 360 million pounds over the last decade. One in three children and one in four teens are overweight or at-risk. Second only to tobacco, obesity is a leading cause of preventable death among Californians and costs the state $28.5 billion in health care costs, lost productivity and workers’ compensation.

The League of Women Voters invites the public to a candidates’ forum for Hannah-Beth Jackson and Tony Strickland, candidates for the State Senate District 19.

The forum is co-hosted by The League of Women Voters, Calif. Lutheran University and the Ventura Mobilehome Residents Council (VMRC). The League of Women Voters is a non-partisan organization that encourages informed and active participation in government.

This State Senate race is the most contentious race in California this election cycle and this forum will be an opportunity for the public to ask their questions of the candidates. In addition to questions from the audience, each candidate will give an opening and closing statement.

WASHINGTON, D.C.—The U.S. Senate late Thursday approved the accession of Albania and Croatia to NATO membership.

Congressman Elton Gallegly (R-CA), who is a longtime advocate of Albanian and Croatian NATO membership, called the action a major step towards Balkan stability.

The United States is the third country to ratify Albania’s and Croatia’s entry into NATO. Once all 26 NATO countries take action, Albania and Croatia will become full members. Gallegly urged the other nations to act quickly so Albania and Croatia can be admitted at NATO’s 60th anniversary summit next April.

Gallegly, a senior member of the House of Representatives Foreign Affairs Committee, introduced a resolution recommending Croatia integration into NATO when he chaired the Europe Subcommittee in 2005, which passed unanimously in the House that year. This year, Gallegly introduced House Resolution 1266, which congratulates Albania and Croatia on being invited to begin accession talks with NATO and expresses strong support for the timely completion of the accession process.

The resolution also recognizes the historic nature of this achievement and the comprehensive military, political and economic reforms undertaken by the Albanian and Croatian governments. The House approved the resolution on July 30.

After its passage, Gallegly contacted his Senate colleagues to urge them to promptly move legislation through the Senate ratifying Albania’s and Croatia’s entry into NATO.

“I could not be more pleased with the Senate action,” Gallegly said. “Croatia and Albania have worked for years on comprehensive military, political and economic reforms. They are now ready to make important contributions to NATO and help bring stability to the Balkans, a region that has seen more than its share of wars and ethnic violence in the past several decades.

“I now urge our other NATO allies to approve Croatia’s and Albania’s membership in the alliance prior to the NATO summit in April.”

“The underlying reason for Wall Street’s troubles is the lax standards it has employed for determining who qualifies for home mortgages. Banks and other lending institutions have been giving loans to people who don’t qualify and could not possibly pay back their loans. They have done so using gimmicks and sometimes through outright fraud, but more often under the lax regulations or nonsensical mandates imposed by the federal government. That includes giving loans to illegal immigrants with no discernible income. This bill does nothing to change that. There are no regulations or mechanisms in this bill to tighten standards and prevent a repeat failure.

“We must not bail out those who caused the problem. Instead, we must hold them accountable. This bill may favorably impact financial markets in the short run, but in the long run it will undermine our recovery and our free-market system. It will hurt the very families and businesses it is supposed to protect.

“I have repeatedly said I would vote for this bill only if it focused on Main Street, not Wall Street. But without protections against unscrupulous and overly lax lending practices, Main Street is not protected. It is business as usual, and that is unacceptable. I could not vote for the largest corporate bailout bill in American history without greater assurances that it would restore confidence in our financial system and address the long-term problems that caused this crisis. Therefore, I voted ‘no.’”

California reached another environmental milestone today with Governor Arnold Schwarzenegger’s signing of AB 1879 by Assemblymember Mike Feuer (D-Los Angeles) and SB 509 by Senator Joe Simitian (D-Palo Alto), moving our state on the path toward a comprehensive green chemistry program to reduce or eliminate hazardous chemicals in our products and the environment.

“This bi-partisan package of environmental legislation propels California to the forefront of the nation and the world with the most comprehensive Green Chemistry program ever established,” Governor Schwarzenegger said. “It also puts an end to the less effective ‘chemical-by-chemical’ bans of the past. With these two bills, we will stop looking at toxics as an inevitable bi-product of industrial production. Instead they will be something that can be removed from every product in the design stage—protecting people’s health and our environment. I am excited to lead this effort, which will spur a new era of research and innovation and promises to drive economic growth and competition in the green chemistry sector.”

A bi-partisan effort, AB 1879, is jointly authored by Assemblymembers Feuer and Jared Huffman (D-San Rafael) and co-authored by Assemblymembers Sam Blakeslee (R-San Luis Obispo), Ed Hernandez (D-West Covina), Jose Solorio (D-Anaheim) and Senators Simitian and Ron Calderon (D-Montebello). SB 509 by Simitian was co-authored by Assemblymember Feuer and Senator Ron Calderon.

AB 1879 establishes authority for the Department of Toxic Substances Control (DTSC) to develop regulations that create a process for identifying and prioritizing chemicals of concern and to create methods for analyzing alternatives to existing hazardous chemicals. It also allows DTSC to take certain actions following an assessment that range from “no action” to “restrictions or bans.” The bill also establishes a Green Ribbon Science Panel made up of experts to provide advice on scientific matters, chemical policy recommendations and implementation strategies, as well as ensuring implementation efforts are based on a strong scientific foundation. Moreover, it expands the role of the Environmental Policy Council, made up of the heads of all California Environmental Protection Agency boards and departments, to oversee critical activities related to the implementation of the green chemistry program. Largest Individual Project Allocation to Date Brings Prop 1B Funding Allocation to $4.8 Billion Statewide

Governor Arnold Schwarzenegger today announced the allocation of $730 million Proposition 1B funding to build 10 miles of a High Occupancy Vehicle (HOV) lane on Interstate 405 in Los Angeles (between Interstate 10 and Highway 101). This is the largest individual Proposition 1B project allocation made to date, and was part of more than $800 million in Proposition 1B funding allocated today by the California Transportation Commission (CTC).

“When California voters approved Proposition 1B they wanted action, and we are delivering that action,” said Governor Schwarzenegger. “This funding will not only help relieve the traffic congestion that clogs our Los Angeles freeways – it will create jobs and help stimulate California’s economy when we need it the most.”

$810 million in Proposition 1B funding was allocated today by the CTC. This includes $80 million for HOV lanes in El Dorado County and Sonoma County, and funding for traffic and safety improvements through the bond's Traffic Light Synchronization Program and the State Transportation Improvement Program. The CTC also allocated $69 million from other funding sources for 29 other transportation projects.

Since the passage of Proposition 1B, $4.8 billion has been allocated by the CTC and other state agencies. This week the Governor signed the 2008-09 budget, releasing the $227 million in Proposition 1B funds previously allocated by the CTC in July and August 2008.

As you probably know, because of the deteriorating condition of California’s prisons, its healthcare system is under the control of federal receiver J. Clark Kelso, not the state government, due to a court order that resulted from lawsuits. Mr. Kelso is demanding money from the state coffers to pay for improvements to local jails, re-entry facilities and increased bed capacity.

In response to Mr. Kelso’s demand, Sen. Mike Machado, of Stockton, sponsored Senate Bill 1665, which would have spent $7 billion towards this goal. I believe the Legislature should implement last year’s Assembly Bill 900, which would address the crowding problem by building 53,000 new beds, before passing Machado’s bill.

California needs a cohesive approach to prison reform, not a disjointed effort. That’s why during the final days of the budget negotiations last week, Republicans were poised to pass a budget trailer bill that would have funded the receiver’s bond and build the 53,000 beds required in AB 900. This way, we were properly addressing the first bond before working on the second.

Unfortunately, liberals in the Legislature decided to sneak in language that would have given prison inmates one day of credit for every day served – for simply breathing.

We all know the popular adage “there ain’t no such a thing as a free lunch.” Well, apparently free lunches do exist for far left liberals, and they only apply to convicted felons serving hard time in prisons. Under existing law, early release credits are earned through participation in work training and education programs, not given for free as an entitlement.

But it gets worse. If Proposition 5, the so-called Nonviolent Offender Rehabilitation Act, were to pass, inmates would be entitled to receive additional credits. With the Democrat breathing credits combined with Proposition 5 language, prisoners would be entitled to double credits – so that each day served would result in a three day reduction in sentence!

Senate Republicans tabled this “deal” once we found the offending language. Unfortunately, Democrats insisted that their amendment would not change current law in the hopes that no one would notice. We did, and once again, at the end of the legislative session, no concrete plan for improving our prisons is in place. This is outrageous.

I have requested that the Governor call a special session to resolve this issue once and for all.

Governor Arnold Schwarzenegger today signed the 2008-09 state budget, concluding a very difficult budget year and delivering a real win for Californians with a proposal to achieve meaningful budget reform. It addresses California’s $15.2 billion budget shortfall with a combination of cuts and increased revenues. It fully funds education’s Proposition 98 guarantee and does not borrow funding from voter-approved local government or transportation funds. The historic budget reform package includes a strong rainy-day fund aimed at helping smooth out the unpredictable highs and lows in revenues that plague our state and create massive deficits.

“While California is certain to face a difficult budget situation again next year, this budget does not take money out of people’s paychecks or borrow from voter-approved local government or transportation funds, and it includes real budget reform with teeth,” Governor Schwarzenegger said. “These budget reforms, when approved by voters, will finally put California’s budget on a path toward long-term fiscal stability.”

Throughout California’s history, numerous attempts have been made to reform our state’s broken budget system. When the Governor was elected, he committed to finally end California’s feast and famine budget cycle. In 2004, the Governor worked with the legislature to pass Proposition 58, which took the first step toward budget reform. In 2005, the Governor attempted the next step in budget reform with Proposition 76, and while it was defeated, the Governor remained committed to reform.

Today, the Governor delivered on his commitment with reforms to address two major flaws in the state budget system—wildly volatile revenues and over spending. In fact, had these reforms been in place over the past decade, this year’s budget problem would have been approximately $10 billion smaller and California would have benefited from $8 billion in additional funding available for infrastructure and other one-time purposes. The proposal will now go before voters on the next statewide election ballot. CONTINUED »

SACRAMENTO – Sen. George Runner (R-Antelope Valley) last week was named the legislator of the year by the California Parole, Probation and Correctional Association at an award luncheon held at the historical Claremont Hotel in Berkeley.

“Senator Runner has dedicated his career and his time to the protection of our children and to the support of California's corrections professions," said William Fenton, CPPCA President. “He has demonstrated his commitment to probation and corrections by supporting critical programs such as adult probation, juvenile justice crime prevention act, juvenile probation and camps, and the mentally ill offender crime reduction act.”

CPPCA is a correctional organization that represents the interests of adult and juvenile, state and local, field and institutional correctional personnel and other citizens interested in the corrections profession.

“I am honored and proud to receive this award from such a distinguished organization,” Runner said. “I am also humbled by this wonderful group of men and women whose difficult jobs include protecting our communities, and rehabilitating parolees and probationers to give them a better chance to succeed.”
CPPCA’s membership is composed of line staff, supervisors, managers, support staff and administrators from probation, parole and correctional agencies across the state.

As health insurance and coverage costs increase, some health care lobbyists are calling for more regulation. They claim insurance companies and health plans waste too much money on administrative costs and take too much profit, while not spending enough on patient care. The facts suggest otherwise.

Earlier this session, Assemblyman Dave Jones (D-Sacramento) introduced Assembly Bill 1554, which would regulate health insurance rates. Jones argued, “...health insurance is unaffordable for far too many Californians, and that, without rate relief , more Californians will become uninsured or underinsured... health insurance premium increases are soaring above the rate increases for wages, inflation and medical costs... these excess profits, as well as marketing costs, high executive salaries, excess reserves, and investment income, could be used to provide full coverage to Californians or to reduce rates... rate regulation will not only save money for those who have insurance, but will make it more likely that uninsured Californians will be able to afford coverage.” (AB 1554 was defeated by a single vote in the Senate Health Committee.)

However, that argument ignores the underlying reasons for the costs. Claims that health insurance is expensive only because of overhead and profiteering are useful to rouse anger but are not accurate. Studies have repeatedly demonstrated that medical costs, not administrative costs or profits, drive up the price of health insurance.

For example, a 2004 study by RAND Health found that while HMO premiums increased about 18% from 1997 to 2000, profits remained flat. The study indicated that the increased premiums were used to pay higher claims for medical care and further stated that the chief causes of rising medical costs included “... higher pharmaceutical expenses, technological changes in medical procedures and products, tight labor markets for nurses and physicians, hospital consolidation and market power, expansion of insurance coverage and mandated benefits, and changes in the population’s age structure.”

According to Yahoo’s industry snapshots, the year-over-year net profit margin in the entire publicly-traded health care sector is 10.91%. Net profit margins for health insurance companies over the same period are 5%, or less than half of the industry sector average. In other words, health insurers under-perform the health industry average for net profit margins.

In fact, a 2006 PricewaterhouseCoopers study found that health care spending consists of:

physician services – 24%
outpatient costs – 22%
inpatient hospital costs – 18%
prescription drugs – 16%
other medical services – 6%
consumer services, product support and marketing – 5%
health plan profits – just 3%

Legislation requiring government approval of health insurance premiums fail to address the underlying costs of medical care. Such bills misrepresent the facts of health care costs in California. Worse yet, as the 2004 RAND study stated, “Rate regulation in other insurance markets has resulted in less access to coverage for high-risk individuals, fewer insurers participating in the market, and less incentive for individuals to control costs. These undesirable effects are likely to occur in the health insurance market if health care costs continue to rise while premiums are controlled.” Clearly, these regulations will not help Californians.
