SACRAMENTO, CA. – Sen. George Runner (R-Antelope Valley) today released the following statement in response to the Second District Court of Appeals decision to reinstate enforcement of the 2,000 foot residency restriction provided for in Jessica’s Law (2006’s landmark sex offender law, which was passed by 70 percent of California voters). The Nov. 18 decision supersedes the order of Los Angeles Superior Court Judge Espinoza, which suspended the 2,000 foot sex offender residency restriction in Los Angeles.

“The people of California have made it clear that they do not believe child molesters should live in close proximity to schools, parks and other places where children play. I support the court’s decision to side with California voters and maintain the residency restrictions found in Jessica’s Law in Los Angeles County.

“As our courts continue to review these residency restrictions, they should focus on reasonable distancing alternatives rather than eliminating the 2,000 foot restriction all together.

“The vast majority of sex offenders on parole in Los Angeles County are in full compliance with the residency restrictions in Jessica’s Law. I encourage the court to look for practical solutions that keep the safety of our children a priority.”

WASHINGTON, DC — The U.S. Senate today passed a bill by Rep. Elton Gallegly (R-CA) to outlaw animal crush videos.

The Senate passed the bill by unanimous consent.

“I want to thank Sen. Jon Kyl of Arizona for moving the bill quickly through the Senate,” Gallegly said. “Cruelty to animals is often the first step leading to violence against people. While the torture of defenseless animals is in itself despicable, this bill is one step toward ending this cycle of violence.”

Gallegly’s bill now heads to the President.

Gallegly first passed a crush video bill into law in 1999. Signed by President Bill Clinton, the law effectively shut down the crush video industry. After recent federal court rulings that the 1999 law was too broad, however, crush videos are back on the market.

Gallegly’s current bill, the Prevention of Interstate Commerce in Animal Crush Videos Act of 2010, will prevent video depictions of drowning, impaling, burning and crushing of animals. After careful restructuring, both House members and senators believe Gallegly’s new bill addresses the U.S. Supreme Court’s constitutional concerns.

The 2010 U.S. midterm elections were held, and the results were as expected: The Republicans took the House but did not take the Senate. The Democrats have such a small margin in the Senate, however, that they cannot impose cloture, which means the Republicans can block Obama administration initiatives in both houses of Congress. Last year, Attorney General Eric Holder told the Washington Lawyers’ Committee for Civil Rights and Urban Affairs that the Obama administration’s “commitment to Equal Protection – and to full participation in our nation’s elections – will not waiver. Ruling of federal 3-judge court ‘affirmatively threatens public safety’

Sen. George Runner (R-Antelope Valley) announced that he and other GOP lawmakers, and California district attorneys, police and sheriff, filed a brief Friday in U.S. Supreme Court that seeks to reverse the order of the federal three-judge court requiring early release of some 38,000 California prisoners in order to improve health care provided to inmates.

“First of all, it’s doubtful the district court has the jurisdiction to order California to release or divert convicts from prison,” said Runner, the lead Senate Republican intervenor in the case before the three-judge court.

Runner believes the three-judge panel misinterpreted the law which limits the capacity of a federal court to takeover a state prison system. Known as the Prison Litigation Reform Act, and passed by Congress in 1995, the law states that a federal court “shall enter a prisoner release order only if the court finds by clear and convincing evidence that crowding is the primary cause of the violation of a federal right and no other relief will remedy the violation of the federal right.”

Runner said: “We don’t believe an ongoing violation exists and we know that the three-judge panel’s decision affirmatively threatens public safety.”

The federal three-judge court ordered the massive reduction of California’s prison population based on allegations of constitutionally deficient inmate health care. But federal documents establish that California inmates have lower mortality rates than inmates from 37 other states and even the general public.

“Inmate health care costs California taxpayers more than $14,000 per year per prisoner,” Runner said. “Most California workers wish they had this type of health care access.”

 

TAX BILLS TO BE MAILED: Ventura County Assistant Treasurer-Tax Collector Don R. Hansen announced that the Secured Property Tax Bills for the 2010/11 tax year will be mailed within the next week to 10 days. Property owners who have not received the Fiscal Year 2010/11 secured property tax statement by the end of October should either telephone his office at (805) 654-3744, or send an Email request for a duplicate bill to HelpingHand@ventura.org. A “virtual bill” for each Ventura County taxable parcel is available online through the Tax Collector’s website: www.venturapropertytax.org

Mr. Hansen further reported that the 2010/11 tax statement information is currently loaded into his office’s systems and taxpayers can begin to inquire about their 2010/11 bills, as well as make their payments. Payments can be made by U.S. Mail, by visiting the Tax Collector’s office, or via the Internet from the Tax Collector’s website: www.venturapropertytax.org. A total of 245,155 Secured Property Tax Bills will be issued for 2010/11, representing a total secured tax roll of more than $1.179 billion.

The FIRST INSTALL MENT of the 2010/11 secured property tax is due November 1, 2010, and can be paid without penalty as late as December 10, 2010. Office hours are 8:00 a.m. to 4:45 p.m., Monday through Friday. A payment drop box near the East entrance of the Hall of Administration at the Victoria Avenue County Government Center in Ventura will be available until MIDNIGHT on December 10, 2010.

Mailing a check with the payment stub remains an efficient way to pay your taxes. Payments postmarked on or before December 10, 2010 will be considered on time. Because timeliness of mailed payments is measured by the U.S. Postal Service cancellation mark, if you must wait until December 9 or 10, 2010, it is recommended that you take your payment into the Post Office and have it postmarked in your presence. State law requires that a 10% penalty be collected for all late payments.

New law will use existing Amber Alert system to catch cop killers

SACRAMENTO – Sen. George Runner (R- Antelope Valley) today announced Senate Bill 839, known as “Blue Alert,” has been signed into law by Governor Schwarzenegger. The “Blue Alert”, which will parallel the existing statewide Amber Alert notification system, will be activated when a peace officer has been killed, seriously wounded or assaulted with a firearm and the suspect has fled the scene.

“When an officer is shot, quick apprehension of the shooter is critical to avoid further violence,” said Runner who also authored California’s Amber Alert. “A violent act against a police officer is a violent act against society, and that’s why I believe a Blue Alert system is necessary.”

The plan will use existing Amber Alert technology, allowing officials to send out a Blue Alert with a license plate number or a vehicle and suspect description so that the public can help authorities locate the shooter.

“Anyone who would shoot a cop is an imminent threat to other officers and the public,” said Runner who explained that California will be one of first states to implement the system statewide. Investigators could immediately broadcast information through the Emergency Broadcast System on television and radio and on the freeway signs to alert public.

A public Blue Alert website, similar to the Amber Alert website, will be created by the end of the year. Blue Alert goes into effect on Jan. 1, 2011.
