On October 7, 2010, the CRPA Foundation filed its Reply brief in support of Plaintiffs’ Motion for a Preliminary Injunction to block enforcement of AB 962 immediately while the case is litigated. The lawsuit alleges that AB 962 is unconstitutionally vague because it fails to provide sufficient notice of what ammunition is "principally for use in a handgun," and thus "handgun ammunition" that is regulated under AB 962. It is impossible to determine whether the thousands of different types of ammunition suitable for use in handgun are "principally for use in," or used more often in, a handgun.

Fairfax, VA. - Sen. John McCain (R-Ariz.) and Rep. Trent Franks (R-2) announced their support of Arizona’s Proposition 109 – the Right to Hunt and Fish Constitutional Amendment. Joining them at a press conference in the Arizona State Capitol this morning was former NRA president Sandy Froman. Arizona is among four states with a Right to Hunt and Fish Constitutional Amendment appearing on the November ballot.

“On behalf of millions of NRA members, gun owners and hunters, I’d like to thank Senator McCain and Rep. Franks for their steadfast support of our hunting heritage and preserving this outdoor tradition for generations,” said Chris W. Cox, executive director, NRA Institute for Legislative Action. “Sen. McCain understands that hunters are our nation’s true conservationists and that Prop. 109 is essential to protecting Arizonans’ right to hunt and fish.”

“It is important to protect our rights from those who want to criminalize – and eventually end – all forms of hunting and fishing,” said Sandy Froman, former NRA president. “There have been incremental attacks – area-by-area; species-by-species – on our hunting heritage by radical anti-hunting groups in other states. Prop. 109 will protect Arizona from these radical attacks.”

If adopted, Prop. 109 will protect Arizona’s generations-old hunting and fishing heritage and critical wildlife management practices against the kinds of emotion-driven bans that have been imposed in other states.

The Amendment specifies that all laws and rules pertaining to hunting and fishing “shall have the purpose of wildlife conservation and management and preserve the future of hunting and fishing.” The language requires sound scientific reasoning, not emotion, as the basis for rules and regulations. Prop. 109 guarantees that hunting and fishing will continue to be regulated in a scientific manner in order to benefit wildlife populations.

“Anti-hunting groups are fighting to dismantle hunting and fishing in an effort to eradicate America’s outdoor traditions," concluded Cox. "Prop. 109 guarantees that Arizona’s future generations will be able to enjoy the same heritage their parents and grandparents have passed down to them.”

The South Korean government, in an effort to raise money for its military, wants to sell nearly a million antique M1 rifles that were used by U.S. soldiers in the Korean War to gun collectors in America.

The Obama administration approved the sale of the American-made rifles last year. But it reversed course and banned the sale in March – a decision that went largely unnoticed at the time but that is now sparking opposition from gun rights advocates.

A State Department spokesman said the administration's decision was based on concerns that the guns could fall into the wrong hands.

"The transfer of such a large number of weapons -- 87,310 M1 Garands and 770,160 M1 Carbines -- could potentially be exploited by individuals seeking firearms for illicit purposes," the spokesman told FoxNews.com.

"We are working closely with our Korean allies and the U.S. Army in exploring alternative options to dispose of these firearms."

Preposterous, right? Not to some members of the University of Colorado Boulder faculty.

A recent motion from the Boulder Faculty Assembly (BFA) supports a campus gun ban — as if someone intent on killing would comply with a campus gun ban, let alone regret breaking one.

In less than a week, Arizona residents will be allowed to carry a gun in their pocket or purse without needing paperwork to do so. Senate Bill 1108, which allows people to carry concealed guns with no permit takes effect on July 29.

Fairfax, Va. -- Today, by a margin of 307-113, a bipartisan majority of the U.S. House of Representatives voted to amend the federal definition of protected “household goods” to include firearms on the list of items that cannot be seized by creditors in a bankruptcy proceeding.

NRA-supported H.R. 5827, offered by U.S. Representative John Boccieri (OH-16), would ensure that a person who files for bankruptcy would not lose the constitutionally- protected means of protecting themselves and their families. The bill sets a cap of $3,000 on the value of a firearm collection eligible for the protection, so people in bankruptcy proceedings can continue to own serviceable firearms.

The Senate companion bill is S. 3654, sponsored by Sen. Patrick Leahy (D-VT).

 

Fairfax, Va. -- The National Rifle Association of America today praised the U.S. Supreme Court's historic decision in another landmark Second Amendment case. In a 5-4 decision, the Court ruled that the Second Amendment applies not just to Washington, D.C. and other federal enclaves, but protects the rights of all Americans throughout the country. The opinion in McDonald v. City of Chicago brings an end to the nearly 30 year-long handgun ban that the city has imposed on its law-abiding citizens.

“This is a landmark decision,” said NRA Executive Vice President Wayne LaPierre. “The Second Amendment -- as every citizen's constitutional right -- is now a real part of American constitutional law. The NRA will work to ensure this constitutional victory is not transformed into a practical defeat by activist judges defiant city councils or cynical politicians who seek to pervert, reverse or nullify the Supreme Court's McDonald decision through Byzantine labyrinths of restrictions and regulations that render the Second Amendment inaccessible, unaffordable or otherwise impossible to experience in a practical, reasonable way.”

As a party to the case, the NRA participated in oral arguments before the Court in March. The NRA persuasively argued that the Second Amendment applies to state and local governments through the Fourteenth Amendment and that handgun bans, like those in the City of Chicago and the Village of Oak Park, are unconstitutional under any standard of judicial review. This same view was shared in friend of the court briefs by a bipartisan group of 309 members of Congress from both chambers, 38 state attorneys general, and hundreds of state legislators. Public opinion polls show that it is also shared by the overwhelming majority of the American people.

“This decision makes absolutely clear that the Second Amendment protects the God-given right of self-defense for all law-abiding Americans, period,” said Chris W. Cox, NRA chief lobbyist. “Ironically, while crime in Chicago runs rampant and lawmakers there call on the National Guard for help, Mayor Daley has insisted on leaving the residents of his city defenseless. Today's opinion puts the law back on the side of the law-abiding. We will be watching closely to make sure that Chicago abides by both the letter and the spirit of the Supreme Court's decision.”

When police caught up to a fleeing drug suspect early Thursday, they had little problem arresting him. They found him in a private home he had entered, wounded in the chest by a resident with a handgun. The shooting occurred about a week after an 80 year old Army veteran used a handgun to shoot and kill an armed burglar who had broken into his home. California State Parks and GreenInfo Network have created a web portal that makes it dramatically easier for the public to find and get to any kind of open-space and recreational lands in the Golden State. The FindRecreation web site contains data on everything from federal wilderness areas to neighborhood tot lots, with interactive maps and searching.

"We designed FindRecreation to enable people to find parks near home," said Ruth Coleman, director of California State Parks. "We hope Californians will discover the natural wonders of this state, have fun, get some exercise and feel better." Here's how it works. Go to www.findrecreation.parks.ca.gov. Enter a home address, city or zip code and the site will display a detailed street map or aerial image of every recreational opportunity in the area. By clicking on a particular site, the user can learn more, and get transit or driving directions directly to it. View any site in an interactive 3D map, using Google Earth technology and high-resolution imagery from Microsoft Bing maps. For many areas, the site will show available trails (a forthcoming version will also show parking sites, restrooms and viewpoint outlooks). After that, it is all up to the user to get packed and get going.

"The FindRecreation web gateway is unique in the United States," said Larry Orman, Executive Director of the not-for-profit GreenInfo Network, the site's creator. "It combines state-of-the-art web mapping and searches with a comprehensive inventory of public parks and recreation areas." In addition to parks, Find Recreation also shows the detailed location of over 1,300 public campgrounds in California. Hikers and backpackers can combine FindRecreation's 3D map views with camp locations and trails to help plan simple walks or multi-day outings.

The park and open space areas shown in FindRecreation are part of the California Protected Areas Database (CPAD), a GIS inventory created by GreenInfo Network. CPAD has data on over 15,000 named parks in the state, totaling over 49 million acres and owned by 860 different public agencies and non-governmental organizations. CPAD is the most comprehensive open space inventory ever created for California and is the largest detailed inventory of its kind in the nation (more at www.CALands.org).
