Senator Runner, Legislators And Taxpayer Groups To File Suit Blocking Illegal State Tax Increase

SACRAMENTO – Sen. George Runner (R-Antelope Valley) today joined fellow Republican legislators, the Howard Jarvis Taxpayers Association, the National Federation of Independent Business California and others in filing suit in appellate court to block the enactment of new illegal taxes approved by the Legislature without the constitutionally required two-thirds vote.

Proposition 13, enacted by the voters in 1978, prohibits state elected officials from creating or increasing taxes without a two-thirds vote. However, the Democrats in the Legislature passed a measure in December with a simple majority vote that raises sales tax, income tax, car tax and gasoline tax.

“Apparently, the Democrats believe they can pull the wool over the eyes of California taxpayers and nobody will do a thing,” Runner said. “This law suit sends a strong message to the Democrats that we will not stand idle while they trample the California Constitution.”

Also joining the suit are the Americans for Prosperity, Insurance Commissioner Steve Poizner, Flash Report president Jon Fleischman and KFI radio show hosts John Kobylt and Ken Chaimpou.
