Finance
A. Consideration of the Refinance and Subordination Agreement for 638 Elkins Lane; and Authorize the City Manager, or her designee, to take all necessary actions relating to the City Council’s decision regarding the Subordination Agreement.
Recommendation: 1) Approve the Refinance and Subordination Agreement for 638 Elkins Lane and Authorize the City Manager, or her designee, to take
all necessary actions relating to the execution and recordation of the Subordination Agreement;
or,
2) Deny the Refinance and Subordination Agreement for 638 Elkins Lane and Authorize the City Manager, or her designee, to take all necessary actions relating to the denial of the Subordination Agreement.
B. Consideration of the Refinance and Subordination Agreement for 419 Bridlewood Lane; and Authorize the City Manager, or her designee, to take all necessary actions relating to the City Council’s decision regarding the Subordination Agreement.
Recommendation: 1) Approve the Refinance and Subordination Agreement for 419 Bridlewood Lane and Authorize the City Manager, or her designee, to take all necessary actions relating to the execution and recordation of the Subordination Agreement;
Or
2) Deny the Refinance and Subordination Agreement for 419 Bridlewood Lane and Authorize the City Manager, or her designee, to take all necessary actions relating to the denial of the Subordination Agreement.

D. Consider Recommendation and Provide Direction to Staff Regarding Proposed Closure of Aquatics Center from Monday, October 22, 2012 – Monday, February 4, 2013 or Monday, November 5, 2012 – Monday, February 4, 2013.
Recommendation: Consider information and provide Direction to staff on the pool closing date.

E. Approval of Selection of the Law Firm of Aleshire & Wynder, LLP, as City Attorney and Approval of Retainer Agreement for Legal Services.
Recommendation: 1). It is recommended that the City Council approve the selection of Tiffany Israel and the law firm of Aleshire & Wynder to serve as City Attorney for the City of Fillmore upon such terms as set forth in the
Agreement attached to this Staff Report, and authorize the Mayor to execute an Agreement consistent with the one attached to this staff report.

Recommendation: 1) Consider information and provide direction to staff to prepare pertinent information and bring back for adoption at a later date if the Council wishes to establish a Code of Conduct and/or Code of Ethics.
