Detectives Arrest Suspects for Conspiracy to Commit Murder, Solicitation to Commit Murder, Identity Theft/Fraud

On 3-8-2014, Peter Foy II was in custody at the Ventura County Jail Pre-Trial Detention Facility pending a sentence transfer to state prison. Foy was sentenced to state prison on 3-7-2014.

On 3-8-2014, a jail telephone call was monitored where Foy called Brandon Adams. Brandon Adams is Foy’s co-defendant from Foy’s first narcotic sales conviction in 2012. During this conversation, Foy told Adams he (Adams) would be contacted by a person Foy trusted and Adams should deal with the person. Unbeknownst to Foy, the person was actually an undercover police agent. Foy had earlier conspired with the undercover agent and told the agent to contact Adams to assist with the conspiracy to commit insurance fraud and credit card fraud.

The undercover agent met with Adams in the city of Simi Valley. Adams agreed to commit the insurance fraud and credit card fraud based on Foy’s referral. Adams then introduced Toncher to the undercover agent. Adams and Toncher subsequently solicited the undercover agent to kill two Simi Valley residents. Both intended murder victims were involved in Foy’s previous criminal convictions.

During multiple meetings between the three, Toncher agreed to financially support the killing of the Simi residents through the identity theft/fraud profits.

On 4-3-2014, Adams and Toncher were arrested for the above listed charges and were booked into the Pre-Trial Detention Facility. Their bail is currently set at $5 million each. Multiple search warrants were served and filed with the Ventura County Superior Court. Adams and Toncher are scheduled to appear in Ventura County Superior Court on Monday, 4-7-2014. The investigation into Peter Foy II regarding his involvement in this investigation is on-going. All known potential murder victims were notified of the plot.
